However by offering you this option you are agreeing that we retain ownership of the domain name until 1 year of service is paid for. SvpHost.Com will
provide companies with server space which they purchase from us and
will resell such space. We will not be held liable for our resellers,
but will gladly work with you and our resellers to resolve any issues
regarding your account.
ACCOUNT CANCELLATION.
Account cancellations can be done by submitting a cancellation request using our ticketing system, e-mail, Postal Mail only and need to be made 30 days prior to cancelling. You are ultimately responsible of making sure you cancel your account properly, therefore we WILL NOT offer refunds on your account if you do not cancel properly or in time.
Late Payments A 12% late payment fee shall be automatically applied to anyone PER 30 days or one (1) month of their invoice dates. SvpHost.Com requires all late payments to be made in full plus maximum three (3) months of service in advance if user demands their files and/or account re-activated.We require atleast 30 days for a credit card or 20 days for a check/MO to clear before we unsuspend a suspended user from using the service. SvpHost.Com reserves the right to suspend an account and/or their users from using the service no later than 7 days before their final invoice date for possible fraud and/or of a malicious intent.
SPAM and
Unsolicited Commercial Email (UCE): SvpHost.Com takes a zero
tolerance approach to the sending of Unsolicited Commercial Email
(UCE) or SPAM over our network. Very simply this means that customers
of SvpHost.Com may not use or permit others to use our network to
transact in UCE. Customers of SvpHost.Com may not host, or permit hosting
of, sites or information that is advertised by UCE from other
networks. Violations of this policy carry severe penalties, including
termination of service.
Violation of
SvpHost.Com's SPAM policy will result in severe penalties. Upon
notification of an alleged violation of our SPAM policy, SvpHost.Com will
initiate an immediate investigation (within 48 hours of
notification). During the investigation, SvpHost.Com may restrict
customer access to the network to prevent further violations. If a
customer is found to be in violation of our SPAM policy, SvpHost.Com may,
at its sole discretion, restrict, suspend or terminate customer's
account. Further, SvpHost.Com reserves the right to pursue civil remedies
for any costs associated with the investigation of a substantiated
policy violation. SvpHost.Com will notify law enforcement officials if
the violation is believed to be a criminal offense.
First
violations of this policy will result in an "Administrative
Fee" of $350 and your account will be reviewed for possible
immediate termination. A second violation will result in an
"Administrative Fee" of $500 and immediate termination of
your account. Users who violate this policy agree that in addition to
these "Administrative" penalties, they will pay
"Research Fees" not to exceed $175 per hour that SvpHost.Com
personnel must spend to investigate the matter. PLEASE, DO NOT SPAM
from your account.
[ This spam
policy is to keep our network from being blocked. The fees do not
apply to anyone that can prove they have a double opt-in procedure
they follow before sending out their emails. Masking an IP is not
acceptable even if the emails you are sending are double opt-in. We
reserve the right to suspend and/or TERMINATE an account if found to
be guilty of Spamming and we cannot get in touch with the owner. ]
Suspension
of accounts due to spam: Accounts suspended found to be Spamming
will be charged a domain re-activation fee. This fee is non-refundable
and non-negotiable. Fees varies on the severity and/or number of
complaints. We reserve the right to suspend multiple accounts [ if
applicable ] to prevent further interruptions, network being blocked
and any account suspended for more than 14 days without contact will
be terminated. We will not keep copies of your files if your account
is terminated.
Refund Policy
We allow full
refund of your payment if a refund request is sent to us within 7 days of receipt of payment and signup of an account. Clients can expect to recieve refunds up to 30 days after refund request is recieved. After the 7 day period you have to provide to us via e-mail or our ticketing system a request to cancel service and must be done so 30 days in advance, if you do not send a 30 day notice to cancel your services and request a refund your refund will be denied. All other refund requests will be denied. If you paid for a yearly account you may be eligible for a prorated refund. The prorated refund will be be based on half of the remaining contract. Example if you have 4 months left you will recieve a prorated refund based on 2 months of service.
Our customers are ultimately responsible for the actions of their clients over the SvpHost.Com network, it is advisable that Customers develop a similar, or stricter, policy for their clients.
